Article 2 Units and individuals engaged in the planning, construction, maintenance, management and use of urban road lighting facilities within the urban planning area of ​​this Municipality must abide by these Measures.
Article 3 The Chengdu Municipal Engineering Administration Bureau is the competent department in the construction, maintenance and management of urban road lighting facilities and is responsible for organizing the implementation of these Measures.
The municipal engineering facilities management department is responsible for the supervision and management of urban road lighting facilities in accordance with the prescribed management authority.
Construction, planning, public security, gardens and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the management of urban road lighting facilities.
Article 4 Urban road lighting facilities are state property. Any unit or individual shall take good care of it and have the right to report violations of these Measures.
Chapter II Planning and Construction
Article 5 The planning, construction and renovation plans for urban road lighting facilities shall be incorporated into urban road construction, renovation planning and annual construction plans.
Article 6 The planning and construction plan for urban road lighting facilities shall be formulated by the Municipal Construction Committee and the Municipal Municipal Engineering Administration and shall be implemented after being reported to the Municipal People's Government for approval.
The urban road lighting renovation plan shall be prepared by the Municipal Municipal Engineering Administration and submitted to the Municipal Construction Committee for approval.
Article 7: New residential districts, development zones, and old cities in the city shall be reconstructed. The development and construction units shall incorporate the urban road lighting facilities determined by the urban planning into the construction plan. Article 9 The design and construction of urban road lighting facilities must be undertaken by professional teams with corresponding qualification levels. Chapter III Maintenance and Management
Article 11 Units that undertake the maintenance and repair of urban road lighting facilities shall strictly implement the technical specifications and operating procedures for the maintenance and repair of urban road lighting facilities, and regularly maintain and maintain urban road lighting facilities to ensure the intact and safe operation of the facilities. The Municipal Municipal Engineering Administration shall strengthen the management of urban road lighting facilities, and be responsible for supervising and inspecting the quality of maintenance and repair works to ensure the lighting rate.
Article 12 The urban road lighting facilities invested and constructed by the government shall be maintained and maintained by the Municipal Street Lamp Management Office of the Municipal Municipal Engineering Administration. The urban road lighting facilities invested and constructed by the unit shall be responsible for the maintenance and repair of the units invested or constructed or the units entrusted by them. The urban road lighting facilities in newly built residential quarters and development zones shall be maintained and maintained by the development and construction unit or the unit entrusted by them.
Article 13 The maintenance and repair plan for urban road lighting facilities invested and constructed by the government shall be prepared by the Municipal Municipal Engineering Administration according to the number of urban road lighting facilities and the quota for maintenance and repair, and shall be implemented after being approved by the relevant departments. Article 14: Units that need to be relocated or demolished for urban road lighting facilities or ground and underground construction that may touch the safe operation of urban road lighting facilities shall be reported to the Municipal Municipal Engineering Administration for approval, and the Municipal Street Lamp Management Office shall be responsible for the transfer or dismantling. The cost of the transfer and dismantling shall be borne by the construction unit.
Article 15 If it is necessary to set up advertisements on urban road lighting facilities, it shall go to the Municipal Municipal Engineering Administration to handle the procedures for the occupation of facilities and pay the facilities occupation fees. Among them, the advertisements on the urban road lighting facilities in the Funan River area must be handled in accordance with the “Chengdu Funan River Comprehensive Improvement Development Management Regulationsâ€, after the approval of the Municipal Nanhe Administrative Committee, and then to the Municipal Municipal Engineering Administration. Article 16 The safety distance between trees near urban road lighting facilities and charged objects shall not be less than one meter. Article 17 Units or individuals that have damaged or damaged urban road lighting facilities shall protect the scene of the accident and prevent the accident from expanding. The Municipal Municipal Engineering Administration shall be notified in time to organize repairs and bear the corresponding compensation fees.
Article 18 prohibits any unit or individual from engaging in the following acts:
(1) Destroying and stealing urban road lighting facilities;
(2) Unauthorized dismantling and moving of urban road lighting facilities;
(3) Unauthorized hanging and posting of publicity materials on urban road lighting facilities;
(4) Unauthorized excavation on urban roads to endanger the safety of urban road lighting facilities;
(5) arbitrarily setting advertisements on urban road lighting facilities, erecting communication lines (cables), closed-circuit television lines (cables) or installing other facilities;
(7) Unauthorized access to the power supply of urban road lighting facilities;
(8) Other acts of damaging urban road lighting facilities.
Chapter IV Awards and Punishments
Article 19 The Municipal Municipal Engineering Administration shall commend and reward those persons and individuals who have made outstanding achievements in the maintenance, repair and management of urban road lighting facilities and those who report violations of the provisions of these Measures.
Article 20 Anyone who damages, destroys or steals urban road lighting facilities shall be compensated by the Municipal Municipal Engineering Administration; if the provisions of the Regulations of the People's Republic of China on Public Security Administration Punishment are violated, the public security organ shall impose a warning, a fine or a fifteenth day. The following detentions; if they constitute a crime, they shall be investigated for criminal responsibility according to law.
Article 21 Anyone who commits one of the following acts in violation of the provisions of these Measures shall be ordered by the Municipal Municipal Engineering Administration Bureau to make corrections within a time limit and impose a fine of not less than 1,000 yuan but not more than 5,000 yuan:
(1) failing to obtain the design and construction qualification of urban road lighting facilities to undertake the design and construction tasks of urban road lighting facilities;
(2) failing to design and construct according to the design and construction technical specifications of urban road lighting facilities;
(3) Failure to follow the design drawings or modify the drawings without authorization.
Article 22 Anyone who violates the provisions of these Measures and hangs or posts publicity materials on urban road lighting facilities shall be ordered by the municipal or district municipal engineering facilities management department to make corrections within a time limit and imposed a fine of not less than ten yuan but not more than five hundred yuan.
Article 23 Anyone who commits one of the following acts in violation of these Measures shall be punished by the Municipal Municipal Engineering Administration Bureau; if the loss is caused, the liability shall be liable for compensation according to law.
(1) If the power supply of urban road lighting facilities is used without authorization, it shall be ordered to make corrections within a time limit and imposed a fine of not less than 100 yuan but not more than 1,000 yuan.
(2) If the communication line (cable), closed-circuit television line (cable) or other facilities are installed in accordance with the urban road lighting facilities, it shall be ordered to make corrections within a time limit and imposed a fine of not less than 200 yuan but not more than 1,000 yuan.
(3) If the surrounding roads occupy urban road lighting facilities or dismantle or move urban road lighting facilities without authorization, they shall be ordered to make corrections within a time limit and impose a fine of not less than 1,000 yuan but not more than 5,000 yuan.
(4) If advertisements are set up on urban road lighting facilities without authorization, they shall be ordered to make corrections within a time limit and imposed a fine of not less than 1,000 yuan but not more than 5,000 yuan.
(5) Those who arbitrarily excavate the urban road lighting facilities on urban roads shall be punished according to the provisions of Article 42 of the Regulations on the Administration of Municipal Engineering Facilities in Chengdu.
Article 24 Anyone who refuses or obstructs the administrative personnel of a municipal engineering facility to perform official duties according to law shall be dealt with by the public security organ in accordance with the provisions of the Regulations of the People's Republic of China on Public Security Administration Punishment; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 25 If a party is dissatisfied with the decision on administrative punishment, it may apply for administrative reconsideration or file an administrative lawsuit according to law.
Article 26 If a minor violates these Measures and damages urban road lighting facilities, his guardian shall be liable for compensation.
Article 27 If the municipal engineering facilities management department or the responsibility of the maintenance and repair unit of the urban road lighting facilities causes the property or personal injury of the unit or individual, the responsible unit shall be responsible for compensation, and the person in charge directly responsible for it shall Other persons directly responsible may be given administrative sanctions; if they constitute a crime, they shall be investigated for criminal responsibility according to law.
Article 28 The administrative personnel of municipal engineering facilities must conscientiously perform their duties and enforce the law impartially. If they engage in malpractice for personal gains, ask for bribes, accept bribes, abuse their powers or defaming the law, they shall be given administrative sanctions by their units or the competent department at a higher level; if they constitute a crime, they shall be investigated according to law. criminal responsibility.
Chapter V Supplementary Provisions
Article 29 The Longquanyi District, Qingbaijiang District and the county (city) people's government shall, in accordance with these Measures and the actual conditions of the region, formulate specific management measures and report to the Municipal People's Government for the record.
Article 30 The problems arising from the specific application of these Measures shall be interpreted by the Chengdu Municipal Engineering Administration Bureau.
Article 31 These Measures shall be implemented as of the date of promulgation.
