US 5321713 is a patent for the manufacture of laser elements using AlGaN crystals formed on a sapphire substrate. Seoul Semiconductor believes that Nissan Chemical's GaN-based laser diode products infringe the patent, and the export and sale of this product to the United States is unfair trade.
Nichia Chemical Industry and Seoul Semiconductor began litigation against white LEDs in January 2006.
Seoul Semiconductor said that US 5321713, like the US patent "US 146465", is evidence that Seoul Semiconductors filed a patent infringement in July 2007 and sent the Nichia Chemical Industry to the US District Court for the Eastern District of Texas. This time, only the evidence of US 5321713 was submitted to ITC. On November 6, 2007, Seoul Semiconductor also used the US patent “US 5075742†as evidence to sue Nichia Chemical Industry to the US District Court for the Eastern District of Texas.
Regarding these lawsuits, Nichia Chemical Industry said, "This series of US patents is not a self-developed technology of Seoul Semiconductor, but is purchased from a third party." "The registration of the patent right transfer (US 5075742) is on the day of the lawsuit - - "On November 6th," "any product of the company is not covered by the series of patents, and the company believes that there are multiple invalid reasons for this case."
In response, Seoul Semiconductor stated that “(this series of US patents) is protected by the construction strategy of the patent portfolioâ€, recognizing the fact that it was purchased from a third party. However, it denies that its fundamental purpose is to attack the Japanese chemical industry.
